There are generally three scenarios for divorcing a Moroccan. How to arrange a divorce with a Moroccan partner we explain below. Each situation requires different documents and procedures:
Situation 1: You are already divorced in the Netherlands
Then you can have your Dutch divorce recognized in Morocco. For this you will need, among other things:
- Court order of divorce
- Proof of registration of divorce with the municipality
- Declaration of res judicata
- (Copy of) the Moroccan marriage certificate
Situation 2: You want a divorce directly in Morocco (without Dutch proceedings)
In this case, you and your partner must agree to the divorce. You will then need:
- Joint statement of consent
- Original marriage certificate
- Birth certificates of both partners
Situation 3: You are married only in Morocco
If the marriage was never registered in the Netherlands, the divorce will go through the Moroccan court and you will follow the Moroccan divorce procedure. This usually requires:
- The Moroccan marriage certificate
- Your birth certificate
